The terms and conditions of use of the site www.rise-english.ro and of the services offered by ENGLISH BOOST S.R.L.
General Specifications
1.1. Please read the Terms and Conditions presented carefully, as by visiting and/or using www.rise-english.com you agree to these terms and conditions. We recommend that you reread the Terms and Conditions of Use at certain intervals, RISE ENGLISH reserving the right to modify their content, without prior notice.
In the relationship between you and RISE ENGLISH, the owner of this website is a legal entity, having the following identification data: ENGLISH BOOST S.R.L., located in Cluj-Napoca, Alexandru Vlahuță Street, no. 31, apt. 49, Cluj county, Fiscal Code 46381574, J12/3894/28.06.2022, social capital 200 lei, bank account RO56BTRLRONCRT0CH3802401, opened at Banca Transilvania, phone 0747 930 527, e-mail office@rise-english.ro, represented by Ferenț Ágota, as administrator.
1.2. We will notify you of any changes in the Terms of Use by posting a notice on our website. Changes made in this way are considered to be accepted by the user if he continues to use the service after displaying them on the website, in the Terms and Conditions section.
1.3. Your use of the applications, services, software applications and websites owned by RISE ENGLISH (collectively referred to in this document as “the Services” and excluding any services provided to you by a separate written contract) is governed by the terms of this document.
A.4. Unless otherwise agreed in writing with RISE ENGLISH, your contract with us will always include at least the Terms and Conditions set forth in this document. These are hereinafter referred to as the “Terms and Conditions”.
1.5. ENGLISH BOOST S.R.L, known as RISE ENGLISH, is a company registered at the Romanian Trade Register, according to the legislation in force. This website and the services offered (except for the sites of the partners to which there are links) are the property of RISE ENGLISH and are controlled exclusively by ENGLISH BOOST SRL, a Romanian legal entity based in Romania. Any dispute related to accessing and using this site is subject to Romanian legislation and falls exclusively within the jurisdiction of the courts in Romania.
NEGOTIATION AND PAYMENT:
2.1. The user will be able to choose from the services exposed on the website www.rise-english.ro the service to which to subscribe as a client of RISE ENGLISH, by contacting us at the e-mail address or telephone number indicated on the contact page of this website, or by directly purchasing an English language course, individually or in groups, by adding it to the shopping cart and completing the sale-purchase by card payment through the intermediary service NETOPIA Payments. If the user does not wish to pay by card, he/she can contact the RISE ENGLISH brand through the form on the website, by e-mail or by phone, to establish other payment methods.
2.2. The user may also choose any of the services offered under this website by contacting ENGLISH BOOST S.R.L., owner of the RISE ENGLISH brand, in order to negotiate a contract for the provision of these services or customized services. RISE ENGLISH offers services to both individuals and companies. The prices displayed on the www.rise-english.ro website are not negotiable.
DELIVERY:
2.3. If the user adds any of the services offered to the basket, and subsequently completes payment, he/she will be contacted by RISE ENGLISH employees for the submission of the contract for the provision of services, respectively to establish the details for the commencement of the courses purchased. The starting date of the English courses will be agreed with the user in the case of individual English courses or will be published on the RISE ENGLISH website when the possibility of enrolment for the chosen course opens. If the course start date changes, the RISE ENGLISH team will contact the client to reschedule the course/communicate the new start date.
2.4. If the user requests a personalized quotation request, he/she will be contacted by the RISE ENGLISH team for negotiation, payment and delivery of the services.
2.5. If the user opts for any of the services offered by RISE ENGLISH, he/she will take a TEST to determine his/her language level, which will determine either his/her belonging to the group of courses offered (depending on the language level) or the starting point of the language process, in the case of individual sessions.
2.6. The user buys services, namely English language lessons, which will be held in a group format or in an individual format, depending on the package chosen by the user. The English lessons will be held in online format, via the ZOOM platform, or in offline format, at the location communicated by the RISE ENGLISH team to the user at least 10 days before the start of the lessons, or at least 1 day before the start of the lessons if the user has registered later.
CANCELLATION AND RETURN OF PURCHASED SERVICES:
2.6 If a user pays on this website for any of the RISE ENGLISH services, they may receive a refund within 48 hours of payment, if requested. The request for a refund is made by sending an e-mail to office@rise-english.ro. This request can be made within 48 hours of purchasing the services, but not if the contract has been signed or the course has started. If the client requests a refund after the contract has been signed or the courses have started, the amount paid will not be refunded, but the client will have the possibility to reschedule the start of the purchased courses. In case of force majeure, RISE ENGLISH will refund the full amount paid by the client.
2.7. RETURN of the services purchased is not possible, due to their nature. Once the English courses have been consumed, the client cannot return the services requested and purchased, and therefore will not be able to request a refund on the basis of a return.
3.1. ENGLISH BOOST SRL, known as RISE ENGLISH complies with the legislation in force regarding the collection and processing of personal data and will use the information collected by the website www.rise-english.ro only for the stated purposes.
3.2. The privacy policy & GDPR is the way we use the personal data received from you when you visit our website. For information about what data we collect from users through the website www.rise-english.ro and how it is stored and processed, please refer to our company’s Privacy & GDPR Policy.
4.1. The content of this website, in all aspects, is the property of ENGLISH BOOST SRL/ RISE ENGLISH, or its partners’, and the information on our website is subject to domestic or international intellectual property protection laws.
4.2. Unless otherwise agreed in writing with ENGLISH BOOST SRL/RISE ENGLISH, no provision of the Terms and Conditions shall grant you the right to use any of the trade names, trademarks, service marks, logos, domain names and any other distinctive signs of the RISE ENGLISH brand.
4.3. If you have been granted an explicit right to use one of these distinctive signs of the brand in a separate written contract with RISE ENGLISH, then you agree that your use of these marks will be in accordance with that contract, the provisions of this policy.
4.4. It is forbidden to copy, modify, create derivatives, perform reverse engineering activities, decompile or try in any other way to extract the source code of the RISE ENGLISH site, the Software Application or part of it, unless you are allowed or required to do so by law, or unless RISE ENGLISH has specifically instructed you to do so in writing.
5.1. RISE ENGLISH collects and processes personal information and data in accordance with the Privacy Policy & GDPR which can be consulted on the website www.rise-english.ro
5.2. RISE ENGLISH cannot control and does not offer any guarantees regarding the security or the content of the information included on this site and does not assume responsibility for any kind of loss, whatever its nature (material or financial).

6.2. RISE ENGLISH is not responsible for the policy of use of these websites, this statement refers only to the Terms and Conditions of use of the website www.rise-english.ro
7.1. Any visitor/user of this site may visit, copy, print or distribute information and documents published by RISE ENGLISH through this site, provided it is for personal use; not to be the object of commercial activity, to be for informative purposes, to obligatorily mention the source, RISE ENGLISH ( www.rise-english.ro), regardless of the way of use.
7.2. The Visitor/User understands and agrees to use the www.rise-english.ro website for legal purposes only. The Visitor/User undertakes to use this site without modifying, copying, distributing, transmitting, publishing, licensing, creating derivative products, transferring or selling any information, products or services obtained from or through this site. The Visitor/User also undertakes not to use or allow any third party to use this website to receive or transmit material that contravenes any law or legal provision in force, obscene, threatening, aggressive, or defamatory.

If you wish to terminate the contract with RISE ENGLISH, you may do so by (a) sending a notice to RISE ENGLISH at any time in confirmation of the contract between you and the undersigned and (b) closing your accounts for the Services you use them for, if RISE ENGLISH has granted you this option. 9.1. By using the RISE ENGLISH Services effectively, you are deemed to have read, understood and accepted these Terms and Conditions. Also, confirm and accept that RISE ENGLISH will consider your use of the company’s website as an acceptance of this policy at the time of access.
9.2. The website www.rise-english.ro is constantly renewed in order to offer the best services to its users. You acknowledge and agree that the form and nature of the Services offered by RISE ENGLISH may change from time to time without notice.
9.3. RISE ENGLISH may modify, revise, improve or discontinue the provision of information, products or services presented on this site or any of the documents included on this site, without prior notice. RISE ENGLISH reserves the right to modify – add, delete, complete, update – all or part of these Terms and Conditions without prior notice. These changes take effect when they are published on the site www.rise-english.ro and are considered to be accepted by the Visitor / User by continuing to use this site.
Force majeure exonerates RISE ENGLISH from liability for non-compliance with these Terms and Conditions and for any other responsibilities that RISE ENGLISH may have by publishing this site. Force majeure means any cause beyond the control of RISE ENGLISH, and includes, but is not limited to fortuitous events, adverse weather conditions, the action or inaction of the government, other companies or competent authorities for which RISE ENGLISH is not responsible.
